DIRITTO DI RECESSO
INFORMATIVA
Gli acquisti effettuati sul sito della Alfa Fashion S.a.s. - sono soggetti alla normativa prevista dal Decreto Legislativo 22 maggio 1999, n. 185, che regolamenta l'esercizio del diritto di recesso, pertanto il consumatore ha diritto di recedere da qualunque contratto a distanza, senza alcuna penalità e senza specificarne il motivo, entro il termine di 10 (dieci) giorni lavorativi decorrente per i beni, dal giorno del loro ricevimento da parte del consumatore.
Il diritto di recesso si esercita con l'invio, entro il termine previsto, di una lettera raccomandata con avviso di ricevimento a: Alfa Fashion S.a.s. - Corso Vittorio Emanuele 398 - 80030 Castello Di Cisterna (NA). Tale comunicazione scritta si intende spedita in tempo utile se consegnata all'ufficio postale accettante entro i termini previsti dal presente decreto.
La comunicazione può essere inviata, entro lo stesso termine, anche mediante telegramma, telex e facsimile, a condizione che sia confermata mediante lettera raccomandata con avviso di ricevimento entro le 48 ore successive.
L'acquirente che intenda esercitare il diritto di recesso tramite posta elettronica, deve inviare entro 10 (dieci) giorni dal ricevimento del prodotto, un'e-mail all'indirizzo alfafashion@alfafashion.com con ricevuta di ritorno (nel caso in cui il software di posta del cliente non preveda la ricevuta, sarà il nostro operatore online a dare una conferma di ricezione) e confermare sempre mediante lettera raccomandata con avviso di ricevimento entro le 48 ore successive.
L'avviso di ricevimento non è, comunque, condizione essenziale per provare l'esercizio del diritto di recesso.
La comunicazione scritta, telegramma, telex, e-mail e facsimile, deve contenere: - La manifestazione della volontà di avvalersi dei benefici concessi dalla legge. - L'indicazione del prodotto acquistato. - Il numero di ordine, di fattura e di Codice Cliente, riportati nella fattura originale che deve essere in vostro possesso. - In caso di recesso parziale, codice articolo/i. - I dati relativi alle coordinate bancarie sulle quali ottenere il bonifico (Cod. ABI - CAB - Conto Corrente dell'intestatario della fattura).*
* Nel caso in cui l'intestatario della fattura oggetto del Recesso non avesse proprie coordinate bancarie, può fornire quelle di un proprio familiare o conoscente facendo esplicita menzione di autorizzazione a Alfa Fashion S.a.s. - ad accreditare l'importo su tali coordinate bancarie a mezzo fax.
Qualora sia avvenuta la consegna del bene, il consumatore e' tenuto a restituirlo o a metterlo a disposizione del fornitore o della persona da questi designata, secondo le modalità ed i tempi previsti dal contratto. Per ottenere la procedura e l'autorizzazione per la restituzione dei componenti, il cliente dovrà contattare il Servizio Clienti dellaAlfa Fashion S.a.s. - all'indirizzo di posta elettronica: alfafashion@alfafashion.com. Dopo aver ottenuto la pratica di rientro dall'operatore, imballare accuratamente i materiali in modo da salvaguardare gli involucri originali dei prodotti da qualsiasi danneggiamento, scritta o apposizione di etichette. Il termine per la restituzione del bene non può comunque essere inferiore a dieci giorni lavorativi decorrenti dalla data del ricevimento del bene. Ai fini della scadenza del termine la merce si intende restituita nel momento in cui viene consegnata all'ufficio postale accettante o allo spedizioniere. Le uniche spese dovute dal consumatore per l'esercizio del diritto di recesso a norma del presente decreto legge sono le spese dirette di restituzione del bene al mittente.
Entro 30 (trenta) giorni dalla ricezione della comunicazione nella quale l'acquirente esprime la volontà di esercitare il diritto di recesso, Alfa Fashion S.a.s. provvederà al rimborso mediante bonifico bancario. Il suddetto rimborso si riferirà alle somme versate dal consumatore, così come evidenziato nella fattura commerciale, spese di spedizione incluse, così come previsto ai sensi del D.L. 185/99.
Il consumatore non può esercitare il diritto di recesso in qualsiasi caso di danneggiamento volontario o fortuito del prodotto.
Il consumatore non può esercitare il diritto di recesso in caso di fornitura di prodotti audiovisivi o di software informatici sigillati, aperti dal consumatore.
Il consumatore non può esercitare il diritto di recesso in caso di ordinazione e/o acquisto di beni confezionati su misura o personalizzati, quindi prodotti su ordinazione, quali "PC ASSEMBLATI" (articolo 5, comma C, del D.L. 185/99).
La normativa comunitaria prevede che il diritto di recesso sia esercitabile dalle sole persone fisiche (consumatori) che agiscono per scopi che possono considerarsi estranei alla propria attività commerciale. Il diritto di recesso, quindi, non può essere esercitato dalle persone giuridiche e dalle persone fisiche che agiscono per scopi legati ad una attività commerciale.
Tutti gli articoli dovranno pervenire nelle medesime condizioni di ricezione, non utilizzati e completamente integri, provvisti degli imballi originali e degli eventuali manuali, senza alcuna mancanza. il consumatore non può esercitare tale diritto di recesso per i contratti di acquisto di prodotti audiovisivi o di software informatici sigillati, che sono stati dal medesimo aperti; parimenti non potrà esercitare tale diritto per prodotti confezionati su misura o chiaramente personalizzati o che, per loro natura, non possono essere rinviati o rischiano di deteriorarsi o alterarsi rapidamente. Nel caso di richiesta di recesso per prodotti di telefonia mobile, comprensivi di scheda pre-pagata, quest'ultima rimarrà di proprietà dell'intestatario. All'atto del rimborso dell'importo relativo Alfa Fashion S.a.s. - decurterà il prezzo della scheda suddetta.
Per quanto riguarda il diritto di recesso applicabile a prodotti di telefonia mobile, esso potrà essere esercitato soltanto nel caso in cui l'uso dell'apparecchio in trasmissione o in ricezione non superi i 15 minuti complessivi ("timer vita"). tale requisito rappresenta il limite entro cui può tollerarsi un utilizzo finalizzato alla verifica del prodotto. Per facilitare le operazioni di rientro al consumatore che manifesti il proprio recesso, sarà comunicato un numero identificativo di ritorno merce mediante messaggio di posta elettronica o comunicazione su una apposita pagina predisposta all'interno del sito. Tale numero permetterà di facilitare le operazioni di rientro della merce, che dovrà avvenire entro e non oltre dieci giorni lavorativi dalla comunicazione del numero di rientro. La restituzione del prodotto di cui si è chiesto ed ottenuto il recesso oltre il predetto termine implica la decadenza dello stesso con contestuale rifiuto della riconsegna. Il diritto di recesso decade nella sua interezza quando viene meno la «condizione essenziale di integrità del bene» (imballo e/o suo contenuto), nei casi in cui la Alfa Fashion S.a.s. - accerti: la mancanza dell'imballo esterno/interno originale; l'assenza di elementi integranti del prodotto (accessori, cavi, manuali, parti, ...); un utilizzo del prodotto tale da rendere impossibile il ripristino alle condizioni pre-esistenti alla vendita.
Alfa Fashion S.a.s. - accetterà la merce resa riservandosi di verificare che i prodotti siano stati riconsegnati nello stato d'origine e con gli imballi integri. E' opportuno rivestire l'involucro originale del prodotto con altro imballo protettivo che ne conservi l'integrità e lo protegga anche da scritte o da apposite etichette. Solo in tal caso provvederà all'inoltro dell'importo versato dal consumatore entro i termini di legge previsti (30 gg.). La Alfa Fashion S.a.s. - provvederà ad accreditare la somma mediante storno del pagamento effettuato con carta di credito ovvero con bonifico bancario. In quest'ultimo caso il Cliente dovrà comunicare le sue coordinate bancarie (Cod. ABI - CAB - Conto Corrente dell'intestatario della fattura) per ricevere il rimborso. Nel caso di decadenza di tale diritto, la Alfa Fashion S.a.s. - provvederà a restituire al mittente il bene acquistato, con addebito allo stesso delle spese di spedizione.
